There are few organizations in the United States that elicit a stronger emotional response than the American Civil Liberties Union, whose stated goal is “to defend and preserve the individual rights and liberties guaranteed to every person in this country by the Constitution and laws of the United States”. Those people include gays, Nazis, women seeking abortion, gun owners, SPAM mailers and drug users. People who are often not popular with various segments of the public. The ACLU’s philosophy is not that it agrees or disagrees with any of these people and the choices that they make, but that they have personal liberties that must not be trampled upon.

In Wikinews reporter David Shankbone’s interview with the President of the ACLU, Nadine Strossen, he wanted to cover some basic ground on the ACLU’s beliefs. Perhaps the area where they are most misunderstood or have their beliefs most misrepresented is their feelings about religion in the public sphere. The ACLU categorically does not want to see religion disappear from schools or in the public forum; but they do not want to see government advocacy of any particular religion. Thus, former Alabama Chief Justice Roy Moore’s placement of a ten ton monument to the Ten Commandments outside the courthouse is strenuously opposed; but “Lone Ranger of the Manger” Rita Warren’s placement of nativity scenes in public parks is vigorously defended. In the interview, Strossen talks about how certain politicians and televangelists purposefully misstate the law and the ACLU’s work in order to raise funds for their campaigns.

David Shankbone’s discussion with Strossen touches upon many of the ACLU’s hot button issues: religion, Second Amendment rights, drug liberalization, “partial-birth abortion” and whether or not George W. Bush should be impeached. It may surprise the reader that many ideas people have about the most visible of America’s civil libertarian organizations are not factually correct and that the ACLU often works closely with many of the organizations people think despise its existence.

On November 16, code-sharing and hosting service GitHub re-enabled the public access to youtube-dl repository, a software which can download videos from the internet via the command-line. This move comes after Mitchell Stoltz, a Senior Staff Attorney of the Electronic Frontier Foundation (EFF), sent a letter to GitHub on the behalf of youtube-dl’s maintainers. The repository was previously blocked on October 23, after GitHub received a Digital Millennium Copyright Act (DMCA) take-down notice from the Recording Industry Association of America (RIAA).

Started in July 2008, youtube-dl is a free/libré open source software written in Python which can download videos from various websites. Citing alleged violation of 17 U.S. Code § 1201 Circumvention of copyright protection systems, RIAA’s takedown notice had alleged youtube-dl was intended to circumvent the technological protection measures of streaming services and to redistribute music videos without authorisation. youtube-dl’s source code had a number of unit tests to check if the software works in different circumstances or not. Some of the test cases included URLs of some copyrighted songs.

In the letter to GitHub, EFF’s attorney Stoltz said “This file contains series of automated tests that verify the functionality of youtube-dl for streaming various types of video. The youtube-dl source code does not, of course, contain copies of these songs or any others […] the unit tests do not cause a permanent download or distribution of the songs they reference; they merely stream a few seconds of each song to verify the operation of youtube-dl. Streaming a small portion of a song in a non-permanent fashion to test the operation of an independently created software program is a fair use.” The letter stressed “youtube-dl does not decrypt video streams that are encrypted with commercial DRM technologies”.

The URLs to copyrighted songs were removed from the source code on November 16, and replaced with a test video that uploaded on YouTube by Philipp Hagemeister, former maintainer of youtube-dl. Philipp Hagemeister had previously spoken about the takedown with Wikinews.

youtube-dl comes with a small JavaScript interpreter where it acts as a web-browser would behave while receiving video data from the server. The script has “extractors” for various websites to handle videos from different sources. “Any software capable of running JavaScript code can derive the URL of the video stream and access the stream, regardless of whether the software has been approved by YouTube”, the letter read. It borrowed an analogy of Doors of Durin from J. R. R. Tolkien’s Lord of the Rings for explanation: travelers come upon a door that has writing in a foreign language. When translated, the writing says “say ‘friend’ and enter.” The travelers say “friend” and the door opens. As with the writing on that door, YouTube presents instructions on accessing video streams to everyone who comes asking for it.

Hours after the public access was restored, Sergey M, one of the maintainers of youtube-dl wrote on GitHub, “We would like to thank @github for standing up for youtube-dl and making it possible to continue development without dropping any features. We appreciate [GitHub] for taking potential legal risks in this regard. We would also like to thank [EFF] and personally [Mitch Stoltz] for invaluable legal help. We would also like to heartily thank our main website hoster Uberspace who is currently being sued in Germany for hosting our essentially business card website and who have already spent thousands of Euros in their legal defense.”

Hours after GitHub restored the public access to the repository, Stoltz tweeted “I think of youtube-dl as a successor to the videocassette recorder. The VCR empowered people to take control of their personal use of free-to-air video, but it had to be saved from the copyright cartel. The same goes for youtube-dl. GitHub did the right thing here.”

youtube-dl is used by thousands of people around the world. Multiple Creative Commons-licensed and public domain videos on Wikimedia Commons are uploaded via a tool called video2commons, which relies on youtube-dl to download media. youtube-dl also lets users download videos from LiveLeak — a video-sharing platform for citizen journalism. Videos downloaded using youtube-dl are also used for the purpose of fair use, or for evidence. When a copyright holder chooses to release their work, be it a photograph, a video, or audio, under a Creative Commons Attribution (CC BY) license, they allow everyone to freely own, share or modify the work as long as the reusers properly attribute the author of the work. YouTube also hosts many audio and video recordings in the public domain which can be used for any purpose without any restrictions.

In the blog post announcing “youtube-dl is back”, GitHub said, “Although we did initially take the project down, we understand that just because code can be used to access copyrighted works doesn’t mean it can’t also be used to access works in non-infringing ways. We also understood that this project’s code has many legitimate purposes, including changing playback speeds for accessibility, preserving evidence in the fight for human rights, aiding journalists in fact-checking, and downloading Creative Commons-licensed or public domain videos.”

GitHub also announced any new 1201 takedown notices will be “carefully scrutinised by legal experts” to reject “unwarranted claims”, and said it will side with software developers if the claims are ambiguous. The announcement also mentioned GitHub Trust and Safety team would treat developer’s tickets as a “top priority”. GitHub also pledged donation of USD 1 million for developer defense fund “to help protect open source developers on GitHub from unwarranted DMCA Section 1201 takedown claims”.

GitHub had blocked public access to many forks of youtube-dl upon receiving the DMCA notice in October. Wikinews notes public access is not yet restored for the forked repositories listed in RIAA’s copyright notice and still displays “Repository unavailable due to DMCA takedown”.

During the period when GitHub had disabled public access for the repository, Sergey M had been developing youtube-dl and hosting it on GitLab, another code-sharing and hosting site. However, since GitHub has restored public access of youtube-dl, Sergey M has made the GitLab repository private.

After this, Wikinews reached out to Richard Stallman, the founder of Free Software Foundation, who has been highly critical of DRM (digital rights management, the subject of the DMCA) for many years now, to discuss the harms of DRM and DMCA 1201.

Valve marking is an important part of your facilitty’s pipe safety. Valve marking enables employees and visitors to identify which valves are associated with specific pipes. This is important if a pipe has a leak, is being repaired or needs to be emptied, for example.

There are various products you can use for valve marking. One of the best choices is a metal valve tag. Metal valve tags are durable, and therefore a great way to label pipes and other equipment in harsh environments.

Aluminum

Aluminum tags are tough and durable for repeated use. These tags do not bend and will not rust, even if they are scratched. Aluminum tags can also withstand temperatures of 1500° F. And, if you want to color code your valves, some companies sell color-coded aluminum tags that are precision engraved to ensure the wording won’t wear off.

Brass

Brass tags are a more economical valve marking option. Similar to aluminum tags, brass tags will not bend or break. But, they can only withstand temperatures of 1200° F.

Stainless Steel

Stainless steel tags are rust resistant and can stand up to highly corrosive environments or extreme weather conditions. These tags can withstand extreme temperature of 2700° F.

Plastic tags are also a viable option for valve marking. Plastic tags can be an economical and easy-to-use option for valve and machine marking. Unlike metal tags, plastic valve tags offer you the option to write right on them, versus spending extra money on engraving.

Self-Fastening

Self-fastening tags allow placement of a tag on valves and equipment without the need for fasteners or tools. Self-fastening tags are flexible, yet durable for high performance. They also resist dirt, grease and moisture. These tags are available in stock legends such as “Do not close this valve” or OSHA-required headers. They even come blank so you can choose your own message.

Economy Plastic

Economy plastic tags are made of thin plastic that can be attached to valves or machines with virtually any type of fastener. Economy plastic tags are not overly durable, so they may not be the best choice for making valves exposed to harsh conditions.

Heavy-Duty Plastic

Heavy-duty plastic tags are made of thicker plastic so they can withstand tougher use. Heavy-duty plastic tags are a more durable, tear-proof tag as compared to economy plastic tags. Like most plastic tags, you can have them custom worded or simply write right on them.

Write on

Most plastic tags can be easily written on for quick valve marking. Some write-on tags come pre-numbered with space to write a personalized label, while others come completely blank for full customization.

A major oil pipeline in Minnesota exploded and caught fire, killing two workers. The pipeline carries oil from Saskatchewan, Canada to close to Chicago, United States, representing 16% of America’s total oil imports.

The section of the pipe that exploded was undergoing maintenance at the time to address a pinhole leak first identified three weeks earlier, and patched at the time with a metal sleeve. On Wednesday, the entire section was removed and replaced with a new one. When oil was reintroduced on Thursday morning, oil leaked where the new section joined the pre-existing pipe, triggering the fatal explosion.

The fire was extinguished later the same day.

The line is split between four separate pipes. After the explosion, all four pipes were shut down, resulting in the global price surge, but this subsided for the most part after it became clear that the three undamaged pipelines had returned to normal operation, restoring 80% of the line’s capacity, and that the accident pipe is expected to be back in use in a matter of days.

“There were no problems found in that area where the leak occurred,” reporters were told by Larry Springer, spokesman for Enbridge, the Canadian company that owns the line. High-tech equipment had been through the line in 2006 to check for any signs of problems.

Enbridge identified the deceased as Dave Mussati Jr. and Steve Arnovich, both of whom were contract workers based in Superior, Wisconsin. The damaged section of pipe is in Clearbrook, which is approximately 350 miles Northwest of Minneapolis.

Enbridge metallurgists have been sent to examine the failed section in an effort to determin the cause of the accident. Other Enbridge workers are working to clear spilled oil from the site. It is expected that once this is complete, the pipe will return to service.

Global crude oil prices temporarily spiked by over US$4 per barrel but closed yesterday slightly above original prices.

When you wish to make a fire pit in your background, there are several ways to accomplish this task. Below you will find one set of step-by-step instructions to approaching this fun and exciting do-it-yourself home improvement project.

1. Identify where you would like to make your fire pit and insert a wooden rod into the center of this location. To the rod, attach a 10 1/2 -inch string with a can of spray paint at the end. While holding the string tight, spray-paint a circle. Next, connect a 22 1/2-inch string to the same spray can and draw another circle. Using these guidelines, dig a trench that measures 10 inches deep and 12 inches wide.

2. Next, place 2 inches of gravel about the trench to create a lining. Tamp the gravel, making it firm to the touch. The gravel will then be covered with concrete that reaches ground level. Using a shovel can eliminate air pockets. Level this area with a piece of 2×4, followed by trowel smoothing. Allow the concrete to harden and then cover it with plastic. This should set for a couple of days with an additional week of open-air curing.

3. Once the concrete has cured, use water to create a mist and smooth out the mortar. Next, press a manhole block measuring 6 inches into the mortar, followed by another piece lying flush against the first. Scrap pieces of 2 x 4 can be used to keep the tops of the blocks in an even pattern. Leaving three equidistant 3/4-inch gaps creates air vents within your fire pit.

4. Continuing to build your own fire pit, you will dry-lay a second layer of 6-inch manhole blocks over the first. Mortar is not used during this step. The blocks should be positioned so that they are flush with one another. Internal edges of this second layer should line up with the bottom layer. A slight lip will begin to form on the outer edge.

5. To continue making your own fire pit, you should mist the blocks of both layers, adding surface-bonding cement to the outside of your creation. Use a wet trowel to smooth out the surface. The top edge of the cement should be clear, so that the wall will accept the cap. The air vents should also be avoided during this process.

6. The last steps to building your own fire pit include cutting fireproof brick capstones into wedges. This can be accomplished with the use of a circular saw. An abrasive masonry blade should be chosen. You will also need a chisel for this step. Make sure that you are wearing your safety goggles during this step!

The Canadian Environmental Law Assocation and the Canadian organization Environmental Defence jointly conducted a study that was released to the public on Thursday, saying that chemicals released by new vinyl curtains may pose a significant health risk.

The study noted that many shower curtains contain more than 100 volatile organic compounds (VOCs), phthalates and organotins, some of which may be released into the air when first taken from a package. These chemicals, responsible for the characteristic smell of new vinyl, may cause damage to kidneys, the liver and the central nervous systems, respiratory problems, nausea, headaches and loss off coordination, according to the report.

These vinyl curtains are also said to contain traces of metals like lead, cadmium and mercury.

Jennifer Foulds of Environmental Defence advises consumers to seek alternatives to new vinyl products such as shower curtains and table cloths. Older products are thought to be safe, as they have already released most of the allegedly dangerous chemicals.

Critics of the study have called it “fear-mongering”, and some health professionals agree that the risk is being overblown. Warren Foster, a professor in the obstetrics and gynecology department at McMaster University in Hamilton, Ontario points out that, “the difference between hazard and risk is great, and without knowing the actual human exposure, it’s premature to make any judgement.”

Foster further commented that the study was not performed in a rigorous manner by not having controls or random sampling.

Five brands of shower curtain were examined in the study; they were purchased from American stores including Bed Bath & Beyond, Kmart, Sears, Target and Wal-Mart. Curtains of the same brand are also available in major Canadian stores.

Marion Axmith, director general of the Vinyl Council of Canada calls the report a “blatant attempt to manipulate consumers and retailers into thinking shower curtains pose a danger, and they don’t.” She noted that, “as far as we know, nobody’s ever been harmed by a shower curtain.”

Vinyl has long been a point of dispute between environmentalists and those in the chemical industry. A chemical used to make vinyl is known to be a risk for liver and other cancers for chemical plant workers, and the phthalates in vinyl products have been linked to interference with normal male hormone production.

Automobile industry pioneer, John DeLorean, died Saturday in a New Jersey hospital by complications from a stroke.

DeLorean was born in 1925 in Detroit, Michigan to European immigrant parents. He received an education in automotive engineering and quickly rose through the ranks of Packard and later General Motors (GM). DeLorean was credited with the development of the Pontiac GTO, which helped introduce the era of “muscle cars”. By 1965, DeLorean led the entire Pontiac division, and four years later was promoted to the prestigious position of leading GM’s Chevrolet.

In 1973, DeLorean quit General Motors and started his own company, the De Lorean Motor Company. The company’s product was the DMC-12, an unusual car featuring an unpainted, stainless-steel exterior and gull-wing doors. The company started production in 1981 but failed less than two years later, having produced under 9,000 vehicles. Despite the company’s failure and the car’s dismal sales, the car itself gained a cult following after the release of the 1985 movie Back to the Future which featured the car as a time-travel machine.

DeLorean himself was in nearly as much trouble as his company. In 1982 he was arrested for attempting to sell $24 million worth of cocaine to undercover police, and after his company’s failure, he became involved in a multitude of lawsuits alleging investor fraud. Though DeLorean successfully resolved the cocaine case after claiming entrapment, his other legal cases would drag on until 1999, when he declared bankruptcy.
